ОЭСР ПРИЗЫВАЕТ ШВЕЙЦАРИЮ ДОРАБОТАТЬ ПАКЕТ НАЛОГОВОЙ КОРПОРАТИВНОЙ РЕФОРМЫ


ОЭСР заявила, что усилия Швейцарии по выполнению своих международных обязательств по реформированию корпоративного налогового режима приветствуются, но отметил, что существует определенная неопределенность в отношении предлагаемого пакета реформ.

ОЭСР опубликовала свое последнее экономическое исследование о Швейцарии. В своем докладе организация заявила, что существует «некоторая неопределенность в отношении реформ корпоративного налогообложения, которые первоначально были отвергнуты референдумом, но они необходимы для согласования налоговой системы Швейцарии с ее международными обязательствами».

НОВОСТИ АВТОМАТИЧЕСКОГО ОБМЕНА ИНФОРМАЦИЕЙ


5 мая 2017 года Организация Экономического Сотрудничества и Развития (ОЭСР) опубликовала две новости касательно международного автоматического обмена налоговой информацией по стандарту CRS. Во-первых, общее количество двусторонних соглашений между странами по этому вопросу перевалило за отметку 1800. А во-вторых, в рамках ОЭСР запущена онлайн-система, в которую будет стекаться информация о потенциальных схемах уклонения от CRS.

СТАНДАРТ ОЭСР ОБ АВТОМАТИЧЕСКОМ ОБМЕНЕ ИНФОРМАЦИЕЙ О ФИНАНСОВЫХ СЧЕТАХ (AIA)


Международная инициатива ОЭСР, направленная на повышение налоговой прозрачности, которую поддерживают более 90 юрисдикций по всему миру. Стандарт состоит из следующих четырех ключевых элементов:

«Model Competent Authority Agreement» («Модельное соглашение между компетентными органами» — «MCAA») устанавливает административную основу для обмена информацией между юрисдикциями-участниками. «MCAA» является рамочным соглашением, действие которого начинается только после вступления в силу соответствующего локального законодательства с учетом требований по защите персональных данных и конфиденциальности информации.

«Common Reporting Standard» («Общие стандарты отчетности») определяют объем информации, которая должна включаться в отчет, а также устанавливают требования к процедуре «дью дилидженс» клиентов.

«CRS Commentary» («Комментарии к «Общим стандартам отчетности») содержат детальные инструкции по применению «Модельных соглашений между компетентными органами» («MCAA») и «Общих стандартов отчетности» («CRS»), включая соответствующие примеры.

«CRS Schema and User Guide» («Алгоритмы применения и пользовательское руководство к Общим стандартам отчетности») содержат общие требования и инструкции в отношении электронной передачи финансовыми институтами информации в налоговые органы.

ШВЕЙЦАРИЯ ПРИЗНАНА СТРАНОЙ, УВАЖАЮЩЕЙ МЕЖДУНАРОДНЫЕ СТАНДАРТЫ НАЛОГОВОЙ ПРОЗРАЧНОСТИ


Глобальный форум по прозрачности и обмену налоговой информацией при ОЭСР дал положительную оценку Швейцарии в области сотрудничества по обмену налоговой информацией.
"Положительная оценка Швейцарии является результатом мер, принятых в ряде областей в течении периода оценки с 1 июля 2012 года по 30 июня 2015 года", – подчеркивает в связи с этим Федеральный департамент финансов, который таrже указывает на то, что Швейцария "оценивается так же, как и другие крупные финансовые центры, такие как Сингапур, Лихтенштейн и Гонконг".

МИНИСТРЫ G7 ОБСУДИЛИ БОРЬБУ С ТЕРРОРИЗМОМ И «ПАНАМСКИЕ БУМАГИ»


В субботу 21 мая в японском городе Сендае прошла встреча глав финансовых ведомств и центробанков "семерки".

В ходе заседания ее участники обсудили текущую ситуацию на валютном рынке, проблему финансирования терроризма, а также недавнюю публикацию "Панамского досье" по офшорам. Эта встреча стала последней перед саммитом G7, который состоится 26-27 мая в префектуре Миэ.

На состоявшейся встрече в Сендае министры финансов и главы центробанков стран "семерки" договорились взаимодействовать для предотвращения случаев финансирования терроризма. В связи с этим был принят новый план действий, который ставит перед собой цель перекрыть террористам доступ к денежным поступлениям за счет ужесточения контроля за банковскими транзакциями и других мер. Документ стал одним из главных итогов встречи.

"Борьба с финансированием терроризма остается одной из приоритетных задач для стран "семерки". Мы намерены и дальше прилагать все усилия для предотвращения терактов и противодействия распространению террористической идеологии", - отмечается в документе. Программа начнет действовать до конца 2016 года.

Новый план состоит из четырех пунктов, включая сотрудничество в области обмена информацией и принятие совместных мер по финансовым санкциям. Кроме того, министры финансов и главы центральных банков "семерки" обязались пересмотреть меры по предотвращению финансирования терроризма, включая регулирование банковских транзакций, а также поддержать ужесточение стандартов FATF.

НАЛОГИ В ШВЕЙЦАРИИ ОДНИ ИЗ САМЫХ НИЗКИХ В МИРЕ


По данным последнего исследования Организации экономического сотрудничества и развития (ОЭСР) уровень налогообложения физических лиц, проживающих в Швейцарии, является одним из самых низких в мире.

В рейтинге стран с самой низкой налоговой нагрузкой (имеются в виду государственный подоходный налог) в категории «одинокие граждане» Швейцария занимает 6-е место, а в категории «семьи» (пара с одним зарабатывающим и двумя детьми) — 4-е. В исследовании были проанализированы налоговые условия 34-х стран, входящих в ОЭСР.

Эксперты, составившие доклад ОЭСР «О налоге на прибыль в 2016 году», измерили как ставки налога на прибыль, так и реальные налоги, а также выплаты в фонды социального страхования отдельных лиц и семей, используя формулу «налогового клина». В соответствии с ней при расчете налоговой нагрузки учитываются налоговые выплаты работников и работодателей минус налоговые льготы, предоставляемые государством.

При этом данная методика не принимает во внимание другие фиксированные статьи расходов, такие, как расходы на здравоохранение и на жильё. Напомню, что в Швейцарии налоги устанавливаются на федеральном, кантональном и коммунальном уровнях и их ставки могут достаточно резко меняться от кантона к кантону или от общины к общине.

Согласно исследованию, среднестатистический работник в странах ОЭСР платит 35,9% налогов. Бельгия имеет самый высокий уровень налогов для одиноких граждан — 55,3%, а в Чили самый низкий — 7%. Налоги на заработную плату в период с 2010 по 2015 годы выросли примерно на 1% во всех странах ОЭСР. В Швейцарии этот рост составил всего 0,2%.

УКРАИНА И АВТОМАТИЧЕСКИЙ ОБМЕН НАЛОГОВОЙ ИНФОРМАЦИЕЙ


29 октября 2014 года была подписана Конвенция по вопросам автоматического обмена информацией (Multilateral Competent Authority Agreement), которая стала основным юридическим закреплением стандарта по обмену автоматической информацией на международном уровне. К концу 2015 года количество участников Конвенции достигло 77.

По состоянию на начало 2016 года Украина пока не присоединилась к Конвенции не инициировала и не озвучила намерения имплементировать механизмы автоматического обмена информацией.

Это означает, что в ближайшее время украинским налоговым резидентам пока не стоит опасаться раскрытия и передачи информации о своих счетах в иностранных банках налоговым органам.

Автоматический обмен информацией о счетах отдельно взятого гражданина Украины будет осуществляться, только если такой гражданин станет налоговым резидентом одной из стран – участников Конвенции (например, переедет на ПМЖ в такую страну).

При этом следует отметить, что вряд ли стоить рассчитывать на то, что Украина продолжит и дальше остаться в стороне от мирового процесса установления финансовой прозрачности. Поэтому, скорее всего, имплементация автоматического обмена информацией по стандарту ОЭСР для Украины всего лишь откладывается на некоторый срок, но не отменяется полностью.

Так же не исключено, что Украина может начать имплементировать стандарт автоматического обмена информацией путем заключения новых двусторонних договоров об устранении двойного налогообложения или внесения поправок в ныне действующие.

Кстати к американскому FATCA Украина уже присоединилась, и украинские коммерческие банки предлагают своим клиентам заполнять и подписывать соответствующие формы.

New mandatory international OECD standards with regard to corporate taxation, including for Switzerland


Bern, 05.10.2015 - Switzerland supports international efforts to achieve greater transparency and a level playing field with regard to the taxation of multinationals. As a member of the OECD, it actively participated in the base erosion and profit shifting (BEPS) project, the final outcomes of which were published today. The Federal Council has instructed the Federal Department of Finance (FDF) to deliver analyses and proposals for implementing the outcomes.

The final outcomes of the BEPS project that were published today by the Organisation for Economic Co-operation and Development (OECD) supplement the first reports of September 2014. They officially complete two years of work on the project. All 13 reports will be presented at the G20 Finance Ministers and Central Bank Governors Meeting in Lima on 8 October, and then at the G20 Heads of State and Government Summit in Antalya on 15 and 16 November 2015.

In general, the project outcomes will allow for better coordination of international tax law rules and make it possible to close the gaps that multinationals could previously use for aggressive tax planning purposes. Moreover, the participation of the largest financial centres will lead to the creation of a level playing field for Switzerland and its competitors.

Some outcomes are regarded as new minimum standards with which all G20 and OECD member states undertake to comply. The minimum requirements concern country-by-country reports, criteria for taxing intangible property (patent boxes), the spontaneous exchange of information on advance tax rulings, access to the mutual agreement procedure for resolving disputes and the inclusion of anti-abuse clauses in double taxation agreements (DTAs). The OECD will set up control systems to monitor member states' compliance with the minimum requirements. Other BEPS outcomes are in the form of recommendations, e.g. rules on restricting the deductibility of interest payments and rules to neutralise the effects of hybrid mismatch arrangements.

The third series of corporate tax reforms currently under way in Switzerland already takes account of certain BEPS outcomes. For example, provision is made for a standard-compliant patent box (or royalty box), as well as the abolition of tax regimes criticised internationally. With regard to the exchange of information on tax rulings, Switzerland will create the necessary legal basis with the approval of the OECD/Council of Europe multilateral administrative assistance convention. The legal foundations for implementing country-by-country reports are also being prepared. This country-by-country reporting will provide a complete overview of multinationals' global allocation of income and taxes paid. Regarding anti-abuse clauses in DTAs, Switzerland will take account of the OECD's work and decide whether it will make the necessary adjustments multilaterally or bilaterally. Finally, concerning the recommendations that are not in the form of minimum standards, the Federal Council has instructed the FDF, in collaboration with the cantons and business circles, to analyse the amendment of Swiss corporate tax law in the light of international developments.

Federal Council initiates consultation on revision of Tax Administrative Assistance Act


02.09.2015 the Federal Council initiated the consultation proceedings on the revision of the Tax Administrative Assistance Act, which provides for an easing of Swiss practices with regard to stolen data. It should now be possible to respond to requests if a foreign country has obtained the stolen data via normal administrative assistance channels or from public sources. However, administrative assistance is still not possible if a country has actively acquired the stolen data outside of administrative assistance proceedings. The proposed legislative amendment will clarify the legal situation while also taking account of international developments.

The Federal Council had previously proposed easing administrative assistance practices in the case of stolen data in 2013 with the first revision of the Tax Administrative Assistance Act. However, the majority of the cantons, parties and business associations rejected the proposal in the consultation on that occasion. Since then, international practice has established that exceptions to the exchange of information will be tolerated only on a very restricted basis. For instance, the exchange of information could be refused if it is incompatible with public policy, such as in the case of requests motivated by racist, political or religious persecution.

Swiss practices were therefore increasingly called into question by numerous countries and the Global Forum. The Federal Council is thus clarifying the legal situation and taking account of international requirements with the proposed legislative amendment. In addition, Switzerland will find itself in a better position for phase 2 of the Global Forum peer review on administrative assistance in tax matters.

Therefore, although Switzerland will continue to reject administrative assistance requests based on stolen data actively acquired by the requesting state outside of administrative assistance proceedings, it intends to respond to requests in the future that are based on data that has been obtained by the requesting state through normal administrative assistance channels or from public sources and that has not been actively acquired in any other way. Nevertheless, the foreign taxpayers concerned will retain their legal right to lodge an appeal against the exchange of bank client data within the framework of administrative assistance.

The consultation will last until 2 December 2015. The bill is due to be discussed in Parliament in summer 2016.

Будет ли Швейцария оказывать административную помощь другим странам на основе украденных банковских данных ?


Швейцария, находясь под давлением ведущих мировых держав и организаций рассматривает возможность оказания административной правовой помощи иностранным государствам в рамках расследования дел связанных с уклонением от уплаты налогов в материалах, которых присутствуют украденные банковские данные. Тем не менее, находящиеся в процессе обсуждения законодательные изменения, по-прежнему содержат нормы признающие невозможность оказания административной помощи странам, которые непосредственно покупают информацию у осведомителей (whistleblowers).

Данные предложения, которые говорят о происходящих значительных изменениях в политике Швейцарии, были представлены для консультаций в среду на этой неделе. Новая политика Швейцарии по этому вопросу и ее практическое применение по-прежнему будет находится под парламентским контролем, прежде чем вступит в силу - скорее всего не раньше начала 2017 года.

До сих пор швейцарские законодатели были решительно против того чтобы украденные банковские данные могли быть использованы в качестве оснований для оказания административной правовой помощи в расследованиях, связанных с уклонением от уплаты налогов, которые осуществляется в других странах. Аналогичное предложение правительства в 2013 году были отклонены на этапе консультаций.

European Parliament's TAXE special committee visits Switzerland


22.05.2015 in Bern, the State Secretary for International Financial Matters, Jacques de Watteville, received a visit from a delegation from the European Parliament's TAXE special committee. The talks focused on the international reform process regarding corporate taxation, the work undertaken in Switzerland in this area, as well as Switzerland's commitment within the framework of the OECD.

The state secretary reminded the delegation that Switzerland is contributing actively to the OECD's efforts within the scope of the base erosion and profit shifting (BEPS) project. He emphasised the need to create a level playing field and fair competitive conditions for all business locations with the development and implementation of international standards for corporate taxation. More generally, he pointed out that these issues require comprehensive analysis and that account also has to be taken of the problem of the direct state aid which is granted in many EU member countries and which adversely affects the competitive conditions.

The Special Committee on Tax Rulings and Other Measures Similar in Nature or Effect (TAXE) is an ad hoc committee appointed by the European Parliament to analyse the ruling practices of EU member states and third countries.

Швейцария готова перейти ко второму этапу подготовки по автоматическому обмену налоговой информацией


Швейцарский Федеральный Совет обсудил предстоящий этап обсуждений в рамках обмена налоговой информацией стран на Глобальном форуме.

Глобальный форум OECD по прозрачности и обмену информацией в целях улучшения контроля над процессом налогообложения проводит экспертные оценки в два этапа. на первом этапе аналитики проверяют необходимые правовые основы для обмена информацией в соответствии с международным стандартом OECD. Во время второго этапа рассматриваются процессы для обмена информацией на практике. В марте OECD признал Швейцарию готовой ко второй фазе и поприветствовал шаги страны в направлении большей прозрачности налогов.

Второй этап, как ожидается, начнется в последнем квартале 2015 года. Федеральный совет заявил, что административная помощь не является проблемой для Швейцарии, потому что он получает в среднем 1500 запросов в год. Совет предложил руководству прояснить правовую ситуацию в отношении запросов административной помощи на основе украденных данных.

«Федеральный совет признает, насколько важно для Швейцарии действовать в соответствие с международными стандартами, которые обеспечивают доверительные экономические отношения со странами-партнерами и благоприятный финансовый климат, которые необходимы для инвестиций», — отметил представитель Федерального Совета.

Federal Council discusses legal basis for administrative assistance in tax matters


During the meeting 13.05.2015, the Federal Council addressed the Global Forum's peer review of Switzerland. It took stock of the challenges to be met by Switzerland in order to pass phase 2 of its peer review, which will get under way in the last quarter of 2015, and talked about what is at stake in this review. The Federal Council will propose to Parliament a clarification of the legal situation regarding administrative assistance based on stolen data.

In its report published on 16 March 2015, the Global Forum on Transparency and Exchange of Information for Tax Purposes (Global Forum) concluded that Switzerland's legal and regulatory framework in terms of administrative assistance allowed it to progress to phase 2 of the peer review. The Federal Council acknowledged that Switzerland achieved this thanks to its intensive work to comply with the global standards.

The phase 2 review itself will look at Switzerland's administrative assistance practices. It is a challenge for Switzerland, which receives an average of around 1,500 administrative assistance requests per year, making it one of the world's most frequently contacted countries for administrative assistance. The treatment of requests based on stolen data is particularly challenging for Switzerland. The Federal Council will propose a clarification of the legal situation to Parliament.

The Federal Council recognises how important it is for Switzerland to comply with the international standards, which ensure smooth economic relations with partner states and good framework conditions, which are necessary for investments.

Out of the tax haven hole: OECD commends Swiss progress


BERN, SWITZERLAND – Switzerland has just received concrete evidence that other countries believe it is making clear progress in sharing information on tax cheats. It has moved up to phase 2 of the peer review process of the OECD’s Global Forum, Jacques de Watteville, head of the State Secretariat for International Financial Matters (SIF), said in a press release issued Monday morning 16 March.

Конец банковской тайны в Евросоюзе – с сентября 2017 г. члены ЕС переходят на режим автоматического обмена информацией


Сегодня (10.12.2014) в Брюсселе министры 28 стран Европейского союза поддержали изменения общеевропейских правил, обязательных для всех государств содружества.

Вводимые меры призваны помочь борьбе с уклонением от уплаты налогов. Речь идет об автоматическом обмене налоговой информацией.

Расширение объемов автоматического обмена информацией распространяется на кредиты, дивиденды, доходы от продажи ценных бумаг и остатки на банковских счетах.

Как напомнила сегодня Италия, председательствующая в ЕС, цель новых правил - помешать уклонению от уплаты налогов и улучшить систему их взимания, поскольку теперь жителям Евросоюза будет сложнее прятать свои средства на счетах в других европейских странах.

"Это конец банковской тайны в ЕС. Страны-члены Евросоюза являются примером для других на международной арене", – прокомментировал сегодняшнюю резолюцию министр финансов Италии Карло Падоан.

Еврокомиссия представила свой проект закона еще прошлым летом. Работа над стандартизацией обмена банковскими данными велась в рамках Организации экономического сотрудничества и развития. Наконец, в конце сентября текущего года ОЭСР представила его вариант на саммите в Австралии, получив поддержку G20.

Federal Council launches consultation on unilateral application of OECD standard on exchange of information upon request

Bern, 22.10.2014 - Today, the Federal Council launched the consultation procedure on the Federal Act on the Unilateral Application of the OECD Standard on the Exchange of Information (GASI). The law should allow Switzerland to swiftly amend its double taxation agreements (DTAs) which do not yet comply with the international standard for the exchange of information upon request. The consultation will last until 5 February 2015.

On 19 February 2014, the Federal Council instructed the Federal Department of Finance to draw up a corresponding draft. The bill for the GASI makes provision for the unilateral application of the provisions of Article 26 of the OECD Model Convention to all DTAs which are not yet in line with the aforementioned international standard. It is part of the Federal Council's efforts undertaken so far to implement the Global Forum's recommendation to create a dense network of information exchange agreements. Amongst other things, these efforts include the bilateral renegotiation of existing DTAs and the conclusion of new DTAs and tax information exchange agreements (TIEAs), as well as the signing of the multilateral OECD/Council of Europe Convention on Mutual Administrative Assistance in Tax Matters on 15 October 2013. All of these measures are in line with the Federal Council's strategy for a competitive and tax-compliant financial centre in line with the international standard.

Switzerland has already revised the majority of its DTA network and signed seven TIEAs. Although 38 of these revised DTAs are in force, a certain number are not yet in compliance with the OECD standard to which the new law would apply. If it were to enter into force today, 69 states or territories would be affected. This number should be lower, however, by the time the law enters into force.

Unilateral application will occur in compliance with the principles of reciprocity and confidentiality of the exchanged information. In concrete terms, this means that Switzerland will continue to refrain from responding to a request if the requesting state is not in a position to respond to requests from Switzerland in line with the OECD standard and is unable to comply with the data protection rules and the principle of speciality. The proposed mechanism is a transitional measure. As soon as states or territories can exchange information upon request with Switzerland on the basis of a DTA in conformity with the standard or another international agreement, the GASI will no longer be applicable to the states or territories concerned. It will be repealed as soon as all of the states and territories concerned are covered by an agreement which makes provision for the international standard recognised by the OECD. Unilateral application concerns only the exchange of information upon request and makes no provision for the spontaneous or automatic exchange of information.

Правительство Швейцарии сообщило, что первый обмен банковскими данными с иностранными государствами начнется с 2018 г. / Automatic exchange of information in tax matters: Federal Council adopts negotiation mandates with partner states

Правительство одобрило мандат на проведение финальных переговоров по изменению системы и текст послания министра финансов Эвелине Видмер-Шлюмпф к Всемирному форуму по вопросу открытости и обмену данными по налогообложению.

Таким образом, Берн подтвердил намерение принять в нужное время соответствующее законодательство для перехода на автоматический обмен данными.

Банки могут накапливать данные о зарубежных налогоплательщиках уже с 2017 года и приступить к обмену банковскими данными в следующем году. Однако нужно, чтобы парламент, вернее, народ Швейцарии, одобрил изменения существующей практики. Из-за использования подобного порядка подхода к проблеме Швейцария запоздает на один год по сравнению с другими странами в сфере осуществления первых обменов данными.

В первую очередь Швейцария начнет переговоры с Евросоюзом для решения вопросов, относящихся к урегулированию накопившихся проблем и доступу на рынки.

Второй раунд переговоров касается Соединенных Штатов. Речь будет идти о пересмотре соглашения FATCA (Foreign Account Tax Compliance Act) для того, чтобы в будущем обмен данными был автоматическим и взаимным.

Automatic exchange of information in tax matters: Federal Council adopts negotiation mandates with partner states


During its meeting 08/10/2014, the Federal Council adopted definitive negotiation mandates for introducing the new global standard for the automatic exchange of information in tax matters with partner states. The competent parliamentary committees and the cantons were consulted on the mandates in recent months. Negotiations with partner states should commence shortly.

On 21 May 2014, the Federal Council approved the draft mandates for negotiations on introducing the automatic exchange of information with the EU, the United States and other countries. The competent Federal Assembly committees and the cantons were consulted on these drafts in recent months. The vast majority supported the draft mandates.

On 21 July 2014, the OECD published the overall package for the automatic exchange of information in tax matters. The swift introduction of the standard was reaffirmed at the meeting of the G20 finance ministers held on 20 and 21 September in Cairns, Australia.

The cornerstones of the mandates definitively adopted by the Federal Council today are as follows:

The introduction of the automatic exchange of information is to be negotiated with the EU.
Regarding implementation of the Foreign Account Tax Compliance Act (FATCA), a Model 1 FATCA agreement should be with negotiated with the United States. With the new agreement, data would be exchanged automatically between the competent authorities on a reciprocal basis.
Negotiations on the automatic exchange of information will be initiated with further selected countries. In an initial phase, consideration will be given to countries with which there are close economic and political ties and which, if appropriate, provide their taxpayers with sufficient scope for regularisation.
The introduction of the automatic exchange of information with foreign countries will be conducted by means of agreements with partner countries. Moreover, implementing legislation will be required in national law. This is currently being prepared by the Federal Department of Finance and will be submitted to parliament together with the negotiated agreements. The existing legislative framework excludes the automatic exchange of information.
Switzerland welcomes the new international standard, to which it contributed actively. It allows for a level playing field in the competition between financial centres, as these regulations apply to all, and is an important instrument in international efforts to combat tax evasion. Domestic bank client confidentiality will not be affected by the implementation of the new global standard.

It is important for the Federal Council that the requirements which it adopted in June 2013 are contained in the new standard. There is to be only one global standard, the exchanged information should be used solely for the agreed purpose (principle of speciality), the information should be reciprocal, i.e. should flow in both directions, data protection must be ensured and the beneficial owners of trusts and other financial constructs should also be identified. Moreover, the Federal Council has stated that the issues of regularisation of the past and market access are to be addressed and solutions sought in negotiations on the automatic exchange of information with the EU and EU member states.

Swiss commitment to the automatic exchange of information at the Global Forum

Furthermore, the Federal Council has agreed to a letter from the Federal Department of Finance (FDF) to the Global Forum on Transparency and Exchange of Information for Tax Purposes. In this letter, Switzerland reaffirms its intention to introduce the statutory basis for the automatic exchange of information in a timely manner so that Swiss financial institutions could commence collecting the account data of foreign taxpayers in 2017 and the first exchange of information could take place in 2018, subject to parliament and possibly voters approving the necessary laws and agreements in good time. A first group of over 40 states, known as early adopters, have announced that they will start collecting data in 2016 and exchange it for the first time in 2017.

Federal Council defines draft negotiation mandates for introducing automatic exchange of information in tax matters with partner states

Bern, 21.05.2014 - At its meeting, the Federal Council adopted draft negotiation mandates for introducing the new global standard for the automatic exchange of information in tax matters with partner states. The relevant parliamentary committees and cantons will be consulted on the draft mandates in the next few months and they should definitively be adopted in the autumn.
The work of the OECD on the new global standard for the automatic exchange of information in tax matters will probably be finalised in June 2014. On 6 May 2014, the ministers of the OECD member states and a few other countries published a declaration confirming this objective. Switzerland also expressly supported this declaration. The OECD Council should approve the new standard in July and the G20 nations should confirm this in September 2014.

It is important for the Federal Council that the requirements which it adopted in June 2013 are contained in the new standard. There is to be only one global standard, the exchanged information should be used solely for the agreed purpose (principle of speciality), the information should be reciprocal, i.e. should flow in both directions, data protection must be ensured and the beneficial owners of trusts and other financial constructs should also be identified. Moreover, the Federal Council stated that, where appropriate, the issues of regularisation of the past and market access are to be incorporated into negotiations on the automatic exchange of information.

In general terms, the introduction of the automatic exchange of information should create a level playing field and Switzerland's reputation and that of its financial centre in the area of taxation and thereby overall competitiveness should be improved.

In the draft mandate, the Federal Council specifically recommends taking the following steps in the further course of action:

- The introduction of the exchange of information is to be negotiated with the EU such that the ongoing negotiations on extending the EU savings tax agreement will be reorientated.

- Regarding implementation of the Foreign Account Tax Compliance Act (FATCA), a switch from Model 2 to Model 1 should with negotiated with the United States. With the new agreement, data would be exchanged automatically between the competent authorities on a reciprocal basis.

- Negotiations on the automatic exchange of information with other selected countries are to be examined. In an initial phase, priority would be given to the introduction of the automatic exchange of information with countries with which there are close economic and political ties and which, if appropriate, provide their taxpayers with sufficient scope for regularisation and which are considered to be important and promising in terms of their market potential for Switzerland's finance industry.

- The introduction of the automatic exchange of information with foreign countries would be conducted by means of separate bilateral agreements with the partner countries. Moreover, implementing legislation would be required in national law. Existing legislation excludes the automatic exchange of information.

The authorities will carry out the work necessary for the introduction in collaboration with the financial sector. In the coming months, consultations on the Federal Council's drafts will be conducted with the relevant parliamentary committees and the cantons. The mandates should be definitively adopted by the Federal Council at the start of autumn. The results of the negotiations and specific legislative proposals will be submitted to parliament later.

Швейцария отказывается от банковской тайны. Окончательно?

Швейцария, вместе с другими членами Организации экономического сотрудничества и развития (ОЭСР), приняла на себя обязательства по автоматическому обмену информацией. Эта договоренность фактически означает конец банковской тайны, объявила ОЭСР.

В 2017 году новая модель автоматического обмена информацией должна прийти на смену действующей системе, которая функционирует только по запросу в рамках налоговых и юридических расследований. Швейцария и Сингапур присоединились к наступлению на банковскую тайну / Switzerland, Singapore join clampdown on bank secrecy

По сообщению ОЭСР, сегодня Швейцария и Сингапур присоединились к все расширяющимся рядам стран, которые согласны обмениваться налоговой информацией на автоматической основе, что является крупным прорывом на пути фактической ликвидации банковской тайны.

Switzerland, Singapore join clampdown on bank secrecy

PARIS (Reuters) - Switzerland and Singapore joined on Tuesday the growing ranks of countries agreeing to share tax information in a major breakthrough against bank secrecy, the OECD said.

Under the pledge signed by a total 47 countries, all financial information will be shared between governments, including taxpayers' bank balance, dividends, interest income and sales proceeds used to calculate capital gains tax.

"It's clearly the end of bank secrecy abused for tax purposes," OECD tax director Pascal Saint-Amans told journalists at a meeting held by the international think tank in Paris.

"It means that governments can really assess the tax owed by people who thought they could hide in other jurisdictions."

While most of the signatories had already committed to sharing tax information on an automatic basis, the fact that Switzerland and Singapore have now also signed up is a big step in a fight against tax evasion that governments have intensified since the global financial crisis.

Facing mounting pressure to dismantle a cherished culture of banking secrecy, some of Switzerland's 300-plus private banks had already signalled last year their readiness to work with U.S. officials to crack down on wealthy Americans.

Switzerland is still the world's biggest offshore financial centre with $2 trillion (1.17 trillion pounds) in assets. But Singapore is breathing down its neck and a 2013 study showed finance professionals see it soon overtaking the Alpine nation amid a global tax crackdown and tighter regulation.

With Tuesday's deal, the OECD devised a common standard to simplify the exchange of financial details, which its 34 members and the 13 other countries agreed to adopt.

Financial companies will also be required to identify the ultimate beneficiaries of shell companies, trusts and similar legal arrangements that at present can be used to evade taxes.
